You have, theoretically, circumvented all legal arguments that I might have.
HOWEVER, that does not change my stance that a marriage, civil union, shotgun wedding, JP wedding, or common law marriage (and no, I don't uphold common law marriages either) should be between a man and a woman PERIOD. Not only does a gay marriage rub my fundamental feathers the wrong way, by changing and/or broadening the definition of one legality, it opens the door for other kinds of definitions being changed. How about changing the US citizenship requirement for being POTUS? Oh, wait....I forgot. We already did that.
