Never any doubt in any conservative's mind that he would. Sotomayore already ruled (one of several rulings under appeal) that ''to possess a gun is clearly not a fundamental right''.

The man was a bad guy/drug dealer, convicted for possession and intent to sell cocaine, and also convicted for possession of a firearm by an illegal alien. He appealed to Sotomayore's court and the opinion issued by the 3-judge panel was that that ''to possess a gun is clearly not a fundamental right.'' (But hey, aren't illegals supposed to be granted the very same same constitutional rights US citizens have? Hasn't that been the lynchpin of liberal politics for years?)
In any event, the idea that the distinction of fundamental right versus constitutional right may become blurred to her is what has gun owners concerned. Will she rule similarly against a citizen, who is not prohibited from owning a firearm because of a felony conviction, and who is not using a weapon in commission of a crime? My bet is that, given the opportunity, she will. I think Obama has included this in her job description.
