In Reply to: LAW WITH REGARD TO UNPAID TRAINING, UNPAID WAIT TIME, DOWNTIME, ETC. - Alice
Many (most?) MTSOs are in violation of Federal Wage and hour laws in some or many areas. I used to be an HR director in another field and in my company, as with most companies outside MT, meticulous care was taken to very strictly follow these laws. The employee's recourse if they feel their company is in violation is to file a complaint with the Wage and Hour Division. MT is a unique field, though, as MT's seem to have a strong desire to maintain their independence from their employer. I have seen so many complaints on this board about MTSOs that require punching a time clock, yet that is the best (and only sure way) that the company can comply with wage and hour laws. I used to work for one of the "biggies" in MT and respected the fact that they had us punch time clocks, because we were ALWAYS paid for overtime, training time, etc. Yet I've seen these same companies slammed because some think that punching a time clock is "demeaning" or "controlling." You can't have it both ways.
