I think all state labor laws are pretty much in line with the federal laws as far as PTO SM

among other things.  Basically, federal law states that an employer is not required to offer paid time off or paid holidays.  An employer doesn't have to pay you for time not worked.  It states quite clearly that PTO is an agreement between the employer and employee upon hire.  So, if you have an agreement with your employer stating you accrue PTO and get certain Holidays off with pay, then upon termination or resignation, you are entitled to any unused time you have accrued.  However, since not mandated by any state or federal laws, if an employer refuses to pay you for any unused PTO, you will have to take legal action, likely in small claims court.  You will probably eventually win, but you have to decide is it worth all the trouble and legal fees?


When you actually get right down to it, labor laws really don't do much for the working class.  We are not guaranteed anything except minimum wage and a safe work environment.


Labor laws in some states (particularly CA) SM
are more stringent and some of the nationals won't hire from certain states because their laws are stricter than federal labor laws.
I have worked for companied in a diff. state - sm
than I live in. I have not have to pay the other states tax. You just have to pay the tax for the state you live in and of course Federal tax and SE tax as well. I have my DH take extra out of his paycheck to cover my SE taxes. Last year owed about 15% of my net after write offs. But the rule of thumb is to reserve about 30% of your gross to cover state and federal, and SE taxes; and if you think you are going to owe pay quarterly to avoid any penalties. I have not "owed" to date as my husband as enough dededucted, but when I think that may change I will start making payments quartly.

regarding how the landlord should handle your deposit during the time you rented from them.  In my state, it must be kept in an escrow account, and the landlord must show proof of this.  Also, landlords are liable for lots of routine maintenance on the house/apartment while it is rented.  For example, landlords are responsible for painting, replacing miniblinds, cleaning carpets, etc every four years, in the state of Georgia.

ex-hubby is not entitled to anything after the date the divorce was filed. So, if she filed for divorce on January 1 and hit the lottery on January 2, he gets nothing!

At least that is how it is in PA. Don't know about other states.
Must check your state labor laws
This is what most of them follow is whatever state you live in. I live in a state where you have to get 40 hrs before you can hit OT. No OT for more than an 8-hour day.

But of course, I also live in a state that has $1.95 as its minimum wage still!

have clients from another state, no I do not need a license. Every state is different. I checked with my attorney and the State Business offices.
I don't know how it made such a small diff in your invoice... made a $100 diff in mine! (sm)

If it were only adding up to three bucks, I wouldn't sweat it. $100? Yeah, that's baseball registration for my son for this year. I am not giving tabs, returns, etc. away free when it adds up to that much difference!  Why should I charge less for a Return than I would for a"K"?


 


 


Pay for Diff Accounts

It seems to me that the pay per line should vary according to the difficulty of the account.


Everyone agrees that the line count can be totally different from one account to the other, so why doesn't the pay vary?  That would be the fair way to do it.


Does anyone know of a company who does that?

What is the diff between these two?  And do most of you have set hours that work as a subcontractor or do you pretty much have flexible hours?  Thanks!
YES, MQ pays shift diff but you have to ask for it. SM
I complained bitterly about it and they gave me half a cent per line for nights and weekends. Adds up to about $75 per check and YES, it is paid on my bimonthly check.

Diff between 1200 lines/day with MQ vs Spheris:
If you type 1200 lines a day for 5 days of the week with each company, here is the incentive difference:

MQ: Incentive would be $0.
S: Incentive would be $24.

That is for the entire week.

I am have done medical transcription for 25 years -- and frankly I thorougly DISGUSTED with the "ME AND ONLY ME ATTIUDE" on this board  -- POOR babies in California whine cause they cant make a living  -- know what? change your life  -- I have managed to stay off this board work a life and help a fellow MT out who is trying to help other MTs wity Katrina  -- I live in Vegas and we have had 1000 evacuess come in -- my first grandbaby is due tomorrow -- I cant be there and I am NOT pissing and moaninng -- MAYBE what we REALLY need to think about is what this country was based upon  -- my family goes back to the Revoution on one side  -- my mothers family goes back to great uncle who said "Go West Young Man"  -- I wear the last name of one of the first men who stepped on the moon  -- you know what? NONE of these men said "get your toys"  - I dont post but when I see NOTHING BUT me -- its upsetting  -- you put the mortgages on at the tune of $100,000 plus "oh I can work at home and have babies and work when I want"  -- well with the price of gas etc and the economy going in the toliet  -- good luck!!!

For us slow pkes---my best would be 3 hours, worst 6 hours - just depends on the dictator ,
I have to look up (i.e. Dr. names, addresses)...I have to do a lot of that and it majorly slows me down, without all that and good not too horrible dicators, in 1 hour I can do anywhere from 15-20 minutes of dictation.
She also has an ad on Career Builders that's signed "Kimberly" out of Arizona, totally diff

Work for a company in a state that has no state income tax
I think there are 3 or 4 out there (Florida, Texas, and a few others.)  Then you really avoid the tax situation. 
But in transcription, if you are good at what you do, you can do 8 hours of work in 4 hours. So eit

you slice it, both companies will still get 8 hours worth of work out of you.


That is the problem I've been having lately being an MT.  Companies want to pay us on production and they set minimum productivity standards, but want us timed in for 8 hours a day.  My thinking is, if they want 8 hours of work out of me, pay me hourly with production incentive.  If they want to pay me on production and tell how much I have to produce in an 8 hour period, then when I hit that mark, I should be able to call it a day even if I've only worked 4 hours.


Seems these companies want it both ways and it is simply not fair to us MTs.  JMO, tho.


Name a state and put every company in that state under suspicion.

Tell what the first letter of the company is and every company with that initial will be suspect.  I would imagine that everyone who works for that company has received an inquiry from department of labor, so they would all be aware of it. 


Why do we persist in setting up companies to be torn down when there is no reason for it.  If a company is suspect, then give the name of the company, don't give big hints that cover at least 5 companies, 4 of which may be the best companies to work for, but fall into the category of an alphabetical letter, etc.

Not mandatory, as you state it depends on your state - sm
or county. Where I am I do not need it; though if I was cutting grass or landscaping I would where I live, makes no sense to me as I am providing a service, but very happy I don't have to have one. We pay personal property tax here and I would have to list all my business related equipment and pay taxes on it every year I was in business. So until I am told otherwise by my county, I will not be getting a business license.

Is this how you do it? Me? I got a PT job so that if my FT job didn't have enough work to meet my needs financially, the two jobs together would.

They hired me to work a specific shift and that is what I am working. If they want me to type after I clock out, then I will happily do so.
I must say, I work long hours, sometimes 12-14 hours a day.
I thought it was important to mention that. However many hours it takes to get the work done is what I do. Some days 12 hours, other days 6 hours and sometimes 14 hours. So, I guess there really is no easy answer.
I do 2000 lines in 6 hours - so maybe 3 hours - nm

In some areas there are laws against leaving a dog tied in a yard like this.  it is considered neglect or abuse or something
OT laws
What you're talking about here is illegal and violates the Federal labor laws. It is also not legal to just not pay someone if they work OT. You still have to pay them, and then deal with not following policy through whatever disciplinary action you have in place. But over 40 hours means OT pay, period. There is no exception to that and if your supervisor is advising you differently, he/she is asking you to break the law.
