don't expect him to show up in the middle of the night, and I wouldn't allow it. Although I can't specify exactly when he does the work, I can reasonably expect him to work during they day. Does that mean he is now my employee? Of course not.
I work as an IC, and as long as I get my work done I am not required to work any specific schedule. I can do it in the middle of the night, so I'm glad I'm an MT and not a plumber.
