If you're not willing to list your clients, then you shouldn't have a noncompete clause in you
contract, IMO.
I worked for a local service at one point. They through a huge account at me that required at least three FT MTs to type and then began to breath down my neck about TAT, blamed me because the client was unhappy and complaining. I contacted the client directly and spoke with her about their complaints. I basically told her that I was the only MT typing for their very large clinic. She hadn't realized that. Long story short, I told her that I had two other MTs, colleagues of mine and that we would be willing to take on her clinic and promise 24 to 48 hour TAT.
I don't know if the line rate I offered her was above or below what she was paying to the service, but she was willing to accept what I had to offer because the doctors were so unhappy. Do I feel guilty about what I did? Heck no! Someone posted the other day that business is business and that we shouldn't be so emotionally vested in our employer. They are not going to be looking out for me. I have to look out for me. Well I agree withat, business is business and the service was blaming me for their mishandling of that account, threatening to withhold my paycheck because of it and actually did withhold my last paycheck when I resigned.
Some of you, especially MTSOs, will say what I did was unethical. This is a competitive business and if you can't take the heat, get out of the kitchen. I refuse to work for services anymore, but if I did, I would flat out refuse to sign any contract with a noncompete clause. I also think that if you are an IC for a service, the service should be required to sign a contract listing the IC terms and conditions. It's only fair.
Just my opinion on the whole contract thing.
I went to the Red Cross to volunteer locally and was told that I needed to apply to the state for a
background check, which will take from 2 weeks to a month to get back. I understand red tape as well as the next person, but is this really necessary? They are asked for people to help load trucks and pack and sort supplies right now, but only from people who are already in "the system." I guess I'll go another route and go to one of the local churches and volunteer, without the red tape.
It is her body...however, the life insider her does not belong to her!
God blessed her with this child and now she needs to find out why. If she is not ready for this then thats her decision but there are other options out there. Abortion is unexceptable birth control. Maybe by taking your niece to an alternative to abortion pregnancy center (family.org has an abundance of info) they can give her all the information she needs to make the best decision not a blind decision. Do you have the latest version of Express Scribe (4.08)? The "Windows Media" mentioned below is what WMA files are.

An MTSO has done the leg work to obtain her accounts, set up her business with equipment and staffing to cover those jobs 24/7. You don't need to know who her clients are. Your position is to transcribe the work sent to you. I believe it is fine to promote any new business you wish to start and compete in a professional manner by calling offices, scheduling appointments to discuss your own fees and what you have to offer, staffing that work, etc. I think what you describe is completely unprofessional. If you have a problem you take it up with the person you contracted with. I think it is just as outrageous and unprofessional that the physician's office discussed this with you as you are not who they contracted with.

Besides that, I have it from two attorneys and the State Department of Labor that noncompete agreements aren't legal in many states. TAKE the ACCOUNT and RUN!!!! This woman has said that you can have them, she doesn't want them. They do want you. You don't owe her any loyalty, especially if she's running her business into the ground. YOU need to look out for YOURSELF. That's what I'm doing today is making a list of every potential transcription client in my city and soliciting them by phone with follow-up letter.

Yes the papers have been served. Seeking legal advice soon. I don't really fear anything as I know we have done nothing wrong. It's just maddening that this person doesn't have anything better to do than to make other people miserable. She doesn't want to make her own money, she tries so hard to take other people's money. I swear, she works harder at trying NOT to work than she would actually have to work if she would just get a job! Get a job lady!

Has anyone ever been sued for breaching a noncompete contract? Do you know what legal steps are involved? How do these things usually turn out? FYI: The contract was never actually breached.....but this former employer BELIEVES it has been and is suing several of her former employees. She owes one of us money (over $3,000.00) for back transcription. We HAD to quit...she wouldn't pay any of us. But the contract was not breached by any of us (probably by her - dirty hands clause - shady business practices, etc.) Any info would be greatly appreciated!

and if they didn't and you didn't, then sorry folks, but it's fair game! There are many, many unethical and illegal (in some cases and in some companies) things going on in the transcription industry.

Seems like they are coming in droves and are getting some of the better jobs, such as construction! My friend couldn't get a job because they were *mainly* hiring "Hispanics" - cheap labor, he was told very bluntly!

My shortcut is mri; which expands to MRI then a space, but if I put mri; hit tab key I will get:

I think the same thing applies, go find where you downloaded it and click on the setup file. All programs will not self-install. If I remember correctly you have to find the install or setup file to start it manually. Sorry for the mix up in programs. Good Luck again.

I would suggest you check the archives of this and other MT boards. I would also suggest you send out a lot of resumes and apply to many companies. A great company for one person might not be a great company for you. I would never quit one company unless I already had a job with another one. If possible, work the 2 jobs to see which one is worth leaving and which one is worth staying with. Don't sell yourself short. You only deserve the best.

you are self employed, remember? therefore YOU are the employer. If you have your house built and the guy who comes to put the siding on is slow, and doesn't know what he is doing, he might only make $3.00/hr by the time he's done. Does he go to your builder and say you need to pay me minimum wage...no, he bid the job and he is responsible for doing enough work in an hour to make it worth his while...just like you are!

You can find online, through magazines, etc. I applied to over 100 when I first started out after school, and finally found someone who was willing to give me a try. You will eventually find someone.
Also, if you can't find someone to hire you right away, write to a company to see if they might give you a short intern position or something. It would be worth a try anyway.

I've been at home for 12 years and it's taking a toll on me. I need some social interaction. There are 2 local hospitals here and one had a unit clerk, nights and weekends. I applied and within a few days, emailed me back and said no. Geez, didn't even get an interview.

Those are problems I usually see in MTs who have received an inadequate education in transcription, or who have only worked for 1 or 2 doctors in-house. If you weren't serious about "Why go to MT school" as a question, then I misunderstood.

Most of the ones I see with pay posted list their high figure as one being below what I would accept, except there are one or two IC ads I have seen that were in my pay range. For employee status, most don't state but I know what my worth is and what I want from a company, which gives real added value to the cpl. It has been my experience that most employers will negotiate the cpl when a good applicant comes their way, so I don't worry much about going through the interview process not knowing the pay scale. Even if I go through all the testing and interviewing and the pay becomes the ONLY issue that would break the deal, I still feel that I learned something from the experience and can apply that to being more selective in choosing another company to apply with. Knowing what the competition of your employer is doing gives you power and confidence in finding your niche.
