Help needed...are there any rights/repercussions for an IC...

who was fired after a year of employment as an IC?  No warning was given. IC had a problem with TAT one day, rather than MTSO firing that day, waited a week and then was just let go.  Is there any way to apply for unemployment....any rights at all for an IC?  Now I will have no income until next job starts.  I have a family to support and bills that are due.  Wow, I am just so surprised!!

We can't abuse the rights of all the child molesters and other criminals, but the rest of us are just out of luck. I have a VERY permanent solution for them--it involves a pair of very rusty and dull pinking shears-- use your imagination.
FTP rights
you might want to have your employer check your logon for the FTP site -- they may not have given you rights to delete files. Simple change on their end.
The merchants would be within their rights
to pursue a criminal complaint against the bad check writers. Posting the bad checks is mild punishment by comparison. Your friend should feel relieved not to be going to jail. Bad checks are theft. I'm with the business people. Irresponsible bad-check writers raise prices and fees for honest, financially responsible people. If this were my friend, I'd be reconsidering the friendship.
renters have rights
Ask for a copy of the bill from the cleaning company they hired to clean it. If you had a pet, carpet cleaning comes out the nonrefundable pet deposit. Typically, if you have lived in a place for more than 2 years, the mgmt company has to replace the carpet and repaint the walls anway. Check it out in your state and local community. They have to have a bill for the 160 dollars. They can't just charge fictitious amounts and have their own people do it.
There's really nothing wrong with that at all. She had the same rights as everybody else. nm

employee rights

The hospital I work for has called the at home Transcriptionist and told them if they do not meet a 1000 line a day line, with a 10,0000 line pay period they would suspend us for three days, the next time is termination.  They also have out sourced alot of the work that has recently been dictated.  My question where do I find legal advice for my line of work.  I am a full time employee, I recieve insurance and retirement, they tell us when we have to work, adding onto our schedule, then tell us we have to work weekends and holidays to lower the count.  We do not receive overtime, holiday pay, vacation time, or sick time.  With us being a full time employee, we have also been by passed when across the board raises have been given to other full time employees.  I just want to know what the in home transcriptionist legal rights are and don't know where to find them.  Thank you in advance for any help you can give.


A question regarding patients' rights
I was just wondering this. My mother was recently sent to a "liver specialist" who is local gastrointestinal doctor because of concern over persistently elevated liver function tests. He drew a LOT of blood work on her and only told her that it looks like she might have a fatty liver. He set her up to come back in six weeks to "get the results of her lab tests."  SIX WEEKS!  With her being  very concerned, of course, we immediately searched the net and found out that fatty liver occurs in patients 1). who drink alcohol (she never has), 2). Patients who are overweight (she is not) or 3). Patients with diabetes (she hasn't got that, either). It says that a liver biopsy is how they find this out. He never mentioned doing one of those. My question is.. would a physician want to wait 6 weeks to find out lab results? You know it doesn't take 6 weeks to get the results back, they probably had them back within a day or two. In the meantime, she is stressing big time about what could be wrong.

You may want to check out the Bangor Daily News online State page for August 7 of this week. President, Michael Deville was found liable for employee discrimination. Sounds like a great place to work. In addition, that manager you are speaking of most likely has no backbone when it comes to standing up when it's require of her.
Of course, I know who owns rights to all my software.
You should also know and understand licensing rights. I also want to give my money to the right people.
KNOW YOUR RIGHTS-LINES, TIME, PTO

Face it - the nationals are going to outsource alot more.  We are no longer immune to the economy.  They are just waiting for some of you to leave - and you will.  Using your PTO now (at their convenience) just means they don't have to pay it to you later.  You can not FIRE someone for lack of performance if there is a lack of work.  The number one eligibility for worker's comp is lack of work and the nationals certainly can't deny that.  If your income has been cut by one-third for 60 days or more, there are better incomes out there (maybe not with nationals), but the American companies do provide good pay, steady work, and understand and respect your rights as a worker.  If it is unemployment you want, do not quit.  Find out now how it works in your state.  There is about a week's waiting period.  You only get about 50% of your income for anywhere from 13-26 weeks.


For those of you who have no choice except to stay - do some research.  If you are full time with good performance records, benefits, and PTO - your job is just as legitimate as if you worked in a factory or any institution in YOUR state.  Your job has to be defined - hours, work, etc.  If your company is not supplying the work, then that changes your job definition.  There are laws in every state to protect you as a worker.  Know them.  They can be different state to state.  Remember, standing up for your rights may get you layed off and unemployment only lasts about 6 months. 


You would do all MTs a favor if you shared some of your research here on different state laws and better companies to work for.

After all, if no one would have stood up years ago, we would still be called the 'typing pool' and making probably $7/hour, AND answering phones, filing, etc.

AAMT did have a huge role in that happening, but I have not seen them do anything for the American MT in a very long time.

According to the Advance Health mag (which is turning into a 'rag' in my opinion), their latest article is how MTs with disabilities are now being trained in INDIA...and elsewhere overseas, and just how wonderful and joyous that all is - !?#@$#@

Contract/no contract -- same rights
You do not have to have a written contract to take them to court.  All you have to do is to prove you have been providing  work to him, past statements/invoice will do that,  you just fill out the small claims forms and go to court.   But first of all I would personally go in and talk with someone about it.   Could be the office manager/bookkeeper and not the doctor that is not paying you.   He may not know anything about it.   And please do not  make the "joke" as above mentioned, that is very LOW class, tacky and not professional at all.  Especially if you are in a small area -- you need to conduct like a professional.  But call and make an "appointment" to talk with the doctor either in person or through a phone call.  Some doctors do not know what is going on in their office and perhaps the office manager wants to be paid first.  If the doctor does know, then in person or over the telephone inform him that you have no other choice but to pursue the debt just as they would if someone did not pay their bill and if that involves going to small claims court, then that is the route you must take.   Good luck.  I did take one to court without a contract and won.

EMR's -- we will still be needed

I work at a clinic part-time typing into EMR's as well as running my own company.  But now they are loading Stedman's spell check and work expanders onto Word so that I can type in word and then transfer the info over to the electronic chart.  I type faster in word.  They found that it is faster for the doc to dictate rather than type into the chart and not only that, insurances were questioning the "standardization" of the chart notes.   Too similar.  So I do make sure that even though I use expanders, and macros, I do make some minor changes to "standard exams" so it does not all look the same, but this is with the approval of the docs.  But they can see at least 4-6 additonal patients and dictate all the notes rather than type then and are able go home at 5 o'clock instead of 7.   Also the TAT is 48 hours and not weeks as the docs would never finish the notes.   So we will still be here just typing under a different format.

Gee, thanks for all that information. I am well aware that I could send an email, and I am well aware of how to crunch the numbers in terms of rate of pay. I was just hoping to hear from someone who already works for the company. Thanks anyway.

Wasn't sure if it was something routine on every sale or if it was that the buyer backed out. I'll just let it stay there and see if I get payment! I'm hoping to get the hang of listing stuff on ebay, but it took me 2 hours to list that one item!  LOL...

I don't spellcheck or audit what I type for postings on the internet.  Maybe I should?  After all, I am posting this for myself, not my employer, but you are right, I should care enough. 


 


I think the MTs that Crabby was talking about in her post ought to care too.  I am burnt out from working 14 hours a day to make up for the $$ that I am not making because we all haven't had a raise since 1988 and I believe that MTs with poor skills are part of the reason why all MTs are not getting paid what they deserve.  Are we the only profession that has not had a cost of living raise in practically forever?  


There is more needed

I have worked as an IC and employee.  For every some companies, you need WORD 2003.  I could not understand why 2007 would not work, but they swear that it would not work with eScription.  Some people told me that they spoke directly with eScription who said it would; needless to say, I had to purchase a very outdated copy from Amazon.com for about $200.  I was also told that it had to be the full version of WORD.  If you are working with eScription, I am sure that part is correct. 


You will have to get a foot pedal, and I was told by last two companies that I was working for (simultaneously) that I had to have a 9-pin foot pedal with a USB adapter which is different somehow than USB alone. 


If you are working from a C-Phone then you can rent this equipment from the company.  This would require the unlimited long distance.


Most require highspeed internet.


The other important thing to know is preparing for self-employment taxes.  That is the big one.


I had the hardest time finding good headphones (which you may already have) but finally found the best ever and VERY inexpensive at dictaionwarehouse .com. The salesman was great help and talked me into the less expensive set which was their best seller.  I had already planned on spending $200 for a good set and only spent $25. (Spectra-RA twin speaker headset).  They have these in digital w/USB, stereo, Dictaphone and many other types of connections.  I am now an employee for a specialty clinic and had to go back to tapes and needed mono-headphones, but I am sure the others would be great also and again VERY inexpensive, but the salesman will be honest and tell you for sure.  I just had to share this after the long drawn out hunt.   


Orator Pro help needed!
While setting up a network connection for my laptop computer, I inadvertantly deleted a network connection that I THOUGHT was not being used. In the process of deleting the networked drive, I also deleted some folders for the Orator Pro phone-in system. Of course, the Bytescribe company is closed, which means there is no technical support for me right now, and my doctors are unable to phone in dictation until I can get the system back up and running. I have a system restore disk from Bytescribe, but I'm not sure how to use it and am afraid I will make things worse. The disk has Symantec's Ghost software, which gives you options for partitioning drives, etc. Is there anyone out there that has made the same mistake in the past or can help me use the system restore disk?

I responded to a job this morning and at their request sent my resume and did not receive a reply until I saw another posting for the same job on this board. I just dont think this is good business.
It pointed out something that NEEDED to be said
The OP is BRAND NEW. She has no idea what is right or wrong. She just believes her way is right and QA is wrong, even "made up". Paddywhack is right. You follow the preferences of the account that provides your paycheck. If you get a different job, their preferences will probably be different. That doesn't make them wrong. It just means that those are the rules you have to follow to get the paycheck. It's not rocket science. It's common sense. The OP needs to get off her high horse and stop thinking she knows everything and start learning what her employer wants so she can KEEP getting that paycheck.

Experienced MTs Needed
AccuStat Carolinas is seeking experienced MTs to work on many multispeciality accounts.  All MTs must have high speed internet acess to apply.  All MTs must reside within the US.  NO OFFSHORE NEED APPLY!!!  Each MT will need to have a 9-pin (serial port) foot pedal.  The client will provide all software needed to perform work.  All work must be 98% or above in accuracy to remain with our company.  AccuStat offers statutory employee or IC status with no restrictions on scheduling for either status.  Pay is sent via mail or direct deposit twice a month.  Pay is 7.5 cpl per line for all transcribed work and 2.5 cpl for all edited work.  The program that you will work with is a VR program so you will have both transcribed and editing work.  Please cut and paste resume into email.  Only eligible MTs will receive response. 
Opinions needed
My son (18) works for a professional tree service.  He travels daily to the boss's house to load up and travel to the work site.  He's been doing this for a little over 2 months.  He goes on the clock to be paid (I didn't know this until yesterday) from the time they reach the destination where they work.  I just found this out and looked up the state's labor law concerning being paid for travel time.  I find that since he is required to meet at the boss's location to load up that his time for payment should start when he starts there and he should be paid for the travel time as well.  Okay, now we know this.  How would you handle this?  I know what I would do, but am looking for other opinions to share the whole picture with my son.  Thanks.

Not needed - in my opinion

I have been told by attorneys and accountants it is  not needed.  The doc signs off on what he dictates and if he does not, I put in "Dictated but not read".  It is his responsibility not ours.   Been at this for over 25 years and never been questioned on if what I typed was what the doc dictated.

Prayers are also needed
Hello: I will say a prayer for this precious little one. He is too young to suffer this way. I also need many prayers for a dear friend with Stage III ovarian cancer, who is undergoing chemotherapy and having a rough time, but has a loving family and is coming home today. It is not hopeless but need prayers.

I also need some prayers for my mother-in-law who is in the hospital with lymphoma and a severe blood infection. If anyone has some extra prayers please send them there way as they are lovely ladies and need a second chance. Thank you. Hope all of our prayers are answered.

 I was offered a home-based MT job as a direct employee of the hospital with an extremely good per-line-rate.   But yes, it was too good to be true!  Apparently on further consideration, the administrator now says it is too costly (technically) for home set-up; mentioned something about the Lanier DVI desktop and how costly etc. etc.  and some other MT has the license (?what's that about?); also mentioned "Cquence" transcription software program.   They already have 5 other off-site MTs.   Anybody out there with opinions and/or constructive advice...please.
