out of one paycheck (that bounced), plus the employer had been lying to me for almost a year about my health insurance! (Was taking $$ out of my paycheck to pay for insurance, but instead kept it for herself.) I went to the Labor Board, paid a very nominal fee to file, and all I had to do was write down what happened, and that I wanted my money that I'd earned, plus what I'd paid for "insurance." Not only was I paid (fairly promptly, too!), but they went into that office and tore it apart, finding many more labor infractions. Business was shut down, and I believe she did some time in jail. Even if I hadn't gotten a time, that alone would've been worth the filing fee!

My suggestion is to call the Labor Board for your state. SM
If you are working in a hospital and you have to physically be there, I think the law states they must pay you an hourly wage. I think they're trying to screw the MTs.

I reported them to California Labor Board. They in turn tore the office apart, found more labor & payment (as well as tax) infractions that employer, put them out of business, and oh, YES - they got me my money. :)
Depends on state labor law where you are...
I live in a state where they have to have a reason, fully documented.
I have lived in states though that are called "right to work" which is probably a strange way to describe it, because they can fire you with no reason whatsoever whenever they feel like it.
But, were you fired or technically just laid off is the other question to answer.
Or maybe check with your state's labor department?

This is what most of them follow is whatever state you live in. I live in a state where you have to get 40 hrs before you can hit OT. No OT for more than an 8-hour day.
But of course, I also live in a state that has $1.95 as its minimum wage still!

Also contact the Attorney General in your state; but the final result for some was to file a complaint with the magistrate in that company's district. Good luck
Labor Board
Forget the state - go to the Department of Labor on website - I had to, my company "borrowed" from my IRA and although I got my money, I did not get my interest, cap gains etc. The labor board is helping me now, including filing charges against them for bouncing checks etc. The problem is if no one complains when the check bounces not much you can do. Bounce a check at walmart and go to court possible jail- bounce a paycheck and do nothing if they send out another to you, doesn't matter when they do, just that they do. If it happens often, don't request a new check file charges and then get your money. They won't do it again.
Labor Board
For those of you who are not getting paid (seems like an epidemic) report your employer to the labor board in your state. A word on Gant Transcription - this being a company who either does not pay or sends checks with insufficient funds - be wary of any advertisements here or on any other board - it's a bad deal - remember you are not working for free - and this company does not pay unless forced to. Don't fall into Gant's trap unless you like spending your days and nights working for nothing. If your company is not paying - keep all correspondence and report them immediately to your labor board - they will straighten things out. The BBB is not the way to go - they can do nothing to get your past wages to you - but the Wage and Labor Board can and will.

Labor Board Denied
The Labor Board only deals with "Employer/Employee" situations. I only have and always only had Independent Contractors that I provide a 1099. She claimed to be an "employee". If you read up on the ABC and/or the 20-law factors of the IRS, you would understand more on this. She also claimed some other issues that did not involve the Labor Board as well. I have all the paperwork.

with such great documentation, it sounds to me like you should be able to call the labor board
or at least unemployment...it is something you really should consider. there are civil service jobs, if you do not want to work at home, and you can get help finding a job that way.
this is what is needed when going to the labor board so they get a clear-cut look at what is happening in this business.
just because it saves a buck, should not mean employees should be able to be treated like dirt...
you have been pushed out of your job, sounds like, and that at least qualifies for unemployment.
believe me, any other job you find out there will be almost the same, but you could collect some money while you look for something with the same pay, am I correct?
SE or not, too, you have lost YOUR LIVELIHOOD. what do people think, like okay you have no way to make a living now...
We supposedly have Labor Day, but I've worked it for years.
I do respect those that have serious religious holidays though and only hope that the company that they work for understand.
At first I kicked myself for picking Mondays as one of my scheduled work days, as most of our holidays fall on a Monday. But the kids sleep in because they have no school, so it always works, as I only have a 3 hour shift and I'm done before they get up.
I think all state labor laws are pretty much in line with the federal laws as far as PTO SM
among other things. Basically, federal law states that an employer is not required to offer paid time off or paid holidays. An employer doesn't have to pay you for time not worked. It states quite clearly that PTO is an agreement between the employer and employee upon hire. So, if you have an agreement with your employer stating you accrue PTO and get certain Holidays off with pay, then upon termination or resignation, you are entitled to any unused time you have accrued. However, since not mandated by any state or federal laws, if an employer refuses to pay you for any unused PTO, you will have to take legal action, likely in small claims court. You will probably eventually win, but you have to decide is it worth all the trouble and legal fees?
When you actually get right down to it, labor laws really don't do much for the working class. We are not guaranteed anything except minimum wage and a safe work environment.

I check out the state board from time to time. Anyone from Mississippi. I know most of the acute care facilities that used MQ. I notice that one of the hospitals is advertising for two inhouse transcriptionists. (RiverOaks/RiverOaks East). Any feedback.

You could try your State Boards board at this site ...
and ask if anybody in your area knows the scoop, assuming you don't mind mentioning the name of the hospital. Or you could give its initials I suppose.

occupational with the city I live in and then the county.....florida is my state.....they didn't require it as long as you had no *traffic* - but the laws/rules changed over time.....

Stiffed by Doctors. What would you do?
How many independent contractors here ever been stiffed by a doctors' office when you didn't have a written agreement? Just did business on a handshake? What did you do to collect payment or did you ever collect payment? I'm being stiffed and know I won't take this sitting down. I worked too long, way too hard. Invoice is teetering 7K. Any help/advice would be very much appreciated. Thank you.

Several of us took them to small claims court. We were able to get paid, but it took awhile. Those that would not go to court never got paid anything.
How soft is the touch, is it a muffled sound (microsoft used to make a very soft touch keyboard.
You can't buy it anymore and I hate the clacky ones. I think a really soft one sounds muffled when you hit the key. Thanks

I do not believe getting the CMT is as worthy as you say. I believe that it is overrated when it comes to getting paid more my by services and I do speak from experience. I had the CMT for many years and I let it lapse because it was a waste of perfectly good money. Money I choose to keep in my pocket rather than spend putting in AAMTs pocket. No, I am quite happy not having the CMT and earn a living wage even without it. As I said previously, I can say as an informed MT (former CMT) that a good 90% or more transcription services do not care if you have the CMT. All they care about is that you can get the job done and at the cheapest rate of pay possible.

Work for a company in a state that has no state income tax
I think there are 3 or 4 out there (Florida, Texas, and a few others.) Then you really avoid the tax situation.
Name a state and put every company in that state under suspicion.
Tell what the first letter of the company is and every company with that initial will be suspect. I would imagine that everyone who works for that company has received an inquiry from department of labor, so they would all be aware of it.
Why do we persist in setting up companies to be torn down when there is no reason for it. If a company is suspect, then give the name of the company, don't give big hints that cover at least 5 companies, 4 of which may be the best companies to work for, but fall into the category of an alphabetical letter, etc.
Contact your local BBB in your state and in their state if different from yours.

Not mandatory, as you state it depends on your state - sm
or county. Where I am I do not need it; though if I was cutting grass or landscaping I would where I live, makes no sense to me as I am providing a service, but very happy I don't have to have one. We pay personal property tax here and I would have to list all my business related equipment and pay taxes on it every year I was in business. So until I am told otherwise by my county, I will not be getting a business license.
