If none are available, ask if the tenants upstairs plan on remaining there for the length of your lease. Anyone who has lived in an apt will figure out what the problem is. You may end up having to move.

If your options are limited for a period of time, and if you should see the person making the noise, ask her if noise from your apt is bothering them (act REALLY concerned) as you would just hate for that to be so cuz you can hear them clearly and then apologize for this. That is, if she is approachable. I would not talk with him about it.
