I'm sure the process may differ from state to state.  We are in Kansas.  When we appeared in front of the Bankruptcy Clerk for the meeting of creditors...they asked us a list of 10 questions..2 of those revolved around refunds..did we get one last year, if so how much..and did we expect one this year.  Several people went before us...those who never received a significant refund were not given the same paperwork we were (I guess they pretty much know you can't get blood out of a turnip lol)...but anyone answering that they had received a refund of $200 or more the previous year were given a sheet with instructions on how to handle your refund which included the steps I posted earlier. 


So depending on where you are filing...it may not be part of their usual process..however..knowing Uncle Sam...I would be too scared to chance screwing him over.  Ask your lawyer first about it.  Your lawyer will know the usual practice on how that is handled.  Glad for your friend that he/she was able to keep all of their refund...but knowing my luck..even IF I got away with it right away...they would find me years down the road and say "oh hey..you owe us this money" and then they'd tack on interest fees.  So we just went the honest route and asked our lawyer up front and he explained it exactly as it happened.  Good luck
