Those are the rules; however, it is so difficult to find a company that abides by those rules.  So, what is our choice?  Either put up with it or pass it up?  The last IC position that I applied for required full-time evening shift, including weekends.  Yes, I could take a day off now and then, but had to give advanced notice.  And, if I took off a day, had to make up the time.  That doesn't sound like IC, does it?  But, my only choice was to accept their terms or keep looking.  As for reporting them to the IRS, there is a form to fill out if I am already working there, but there doesn't seem to be a format for reporting a company at which I have never worked.  As for reporting them to the Labor Board, I'm not sure how to do this.  But, if I had the time and interest, and could just report companies that break the rules, all I would have to do is report their job listings from the various websites.  Many of them have the gall to advertise an IC position with schedule requirements.
