it is contrary to the IRS definition of an Independent Contractor. They MTSO has a right to control the final outcome, but they do not have a right to control the exact means of the outcome. There is a difference between advertising, Majority of physicians dictate between XX-XX, but you are able to work any hours during the week versus We are seeking an IC MT to work M-F 9-5. The latter suggests they are expecting the MT to transcribe during that exact time period. If that is the case, they should be offering employee status.
