Everyone makes his or her own choices and I support that. As to needing counsel, no one needs legal counsel for this. All they need to do is be able to read the IRS publications, read the phone book to get the IRS phone number or address, and a voice to speak up. Many (surely not all) MTSOs will take advantage. If people let them, they have only themselves to blame.
Marie/private counsel
I do have private counsel because I own a business. However, it is not at all necessary to use a lawyer for something like this. All she has to do is to to the IRS website, read the information about IC classification, and call the local office for an appointment. She should bring a copy of her contract (if any) with the company and just tell them what is happening. The IRS is pretty savvy and will likely take it from there. Many MTs feel powerless. There is really a lot we can do for ourselves. Many MTSOs will take advantage. (There are also many, many good ones as well.) My bottom line is that I myself would have my attorney or CPA make the call; but an attorney is not necessary for this. All it would take would be one report and the IRS would be on that MTSO like white on rice.
