Required hours for IC work~~curious

I keep seeing ads where you are required to submit a schedule and work scheduled hours for IC positions.  Is this legal?  I thought that was an IRS requirement of independent contractors that you do your work on your own time.  Am I wrong?  It seems like the industry is headed in this direction.  Companies don't want to hire employees and don't want to pay taxes either..  I guess I can understand that, but I am not sure how they can get away with it.


Yeah, out of work this a.m. ALREADY -- Transtech overhires to cover their rears!
We have been running out of work consistently for the past several months.  You have to work every hour of the day to get your lines, always asked to FLEX your schedule, yet they DEMAND that you work your schedule!  LOL  They have really overhired within the past couple of weeks and we have NO WORK AT ALL NOW.  Very hard to get your line count or make a DECENT PAYCHECK now.  Hope that helps.
Yeah they dock you a days pay if they want to. not fair.

I understand they have a high percentage of ESL, willing to do that for flexibility and less than 20 hours per week PT.  I would love just 8-10.  Anyone know if it is worthwhile contacting Futurenet or know any others that hire limited hours PT?
Yes it does, but 35 hours a week is all that is required to be full time and get bennies.

Maybe is it for a particular account. I work M-F. You are required to work one weekend an month.

10-15 an hour for 8 hours is better than nothing for 8 hours when there is no work.

You misunderstood. You are required to work
That is not a falsehood. It is true you have 24 hours to get the lines in but does that mean there will be lines there to get in during the day. E mails are constantly sent urging people, even using strong language for people to work Friday through Sunday and evenings, to skip soccer games and family activities to work because that is when the work is there. Please don't glaze things over by calling it a falsehood. They don't say they require anything but 1 weekend day and the rest of the time during the week BUT the contract also says they don't have to provide work to you at all at any time. It is stressed that as an MT you must s-t-r-e-t-c-h to make sure our jobs stay in this country. That means: in other words, they overhired, so get the lines in when you can and that better be nights and weekends,or whenever they e mail you to jump. Now call that a falsehood, and you will certainly be misinformed.
You are required to work your schedule, even

if you get your lines in.  OT is paid at the standard 1-1/2 times your rate, but you don't get OT for typing over 1200 lines a day, unless you do the lines outside your normal schedule.  If you are scheduled to work 9 to 5 whatever lines you do are at your line rate.  If you work before 9 or after 5 those lines will be paid at 1-1/2 times your rate, so if you make 10 cpl, then OT will be 15 cpl.  Also there is a shift differential.  I'm not sure the exact hours are per shift, but if you work anything other than first shift there is a differential. Third shift pays a higher differential than second.


They also pay for downtime, so if the servers are down or there is a lack of work (which we have been on OT for months), then you keep track of your time and they pay an hourly rate.  If you are a productive MT you would make more money typing, but at least it is something.  You aren't required to make up lines outside your shift either.

But I don't suppose this is a new issue, is it?  Leads have to get in their lines, too, which I was surprised to learn - however, it shed light on a lot of things, like getting all crap/ESL, difficult work, this was before good work went VR and we actually did have some good dictators. 


But as soon as one of the good jobs turned up in the MTs queue (after a while can often tell by MD ID#) - it disappeared just as fast, replaced by a piece of ----.  Had asked lead a few times after this happened, who rudely answered that, what difference did it make to me - I hadn't started on the job yet, anyway.


In all fairness, work should flow naturally - first come, first serve, with the next available MT for the next available job.  But as long as the Leads have control over this, they'll continue to get the best work.  Lot of complaints also on this board re. Cherrypickers and blaming the MT (who get blamed for most everything, anyway) we need to look at WHO has control over work distributed and who benefits from having that control, and it's not the MT.

As bad as things were at the Q, we got 1 job at a time, detmined via automation, to whatever MT was free was the next to get that job - no one to pick the best work for herself and give MTs the garbage.  All this BS about TAT - best work gets taken first, MTs get squat.  And how many people do we have to answer to, anyhow?  You have top supe, account supe, supe of transcription, and leads like Carter's has pills.  No wonder we get all ESLs and garbage - done by those who have the power to dictate who does what work.  In the next life, just make me a Lead -- they can even keep the hourly/weekly salary -- just let me have first grab at the available dictation!

You're wrong. You are not required to work one weedend day a week.

Decent place to work - the owner is fair and reasonable.
I have known GG, the owner, for a long time. I worked for her as an IC and never had a problem, except for the no work syndrome, but that was about 5 years ago. Hope they are busier now.

If I had to go back and work for a company, JLG would be the place.

I am a remote employee directly for a hospital now, so no need to work for a company.

I can vouch for JLG anytime. Pay is always on time, their staff is friendly and professional, never had a problem with QA.

Well, what do they do when people dont meet their required lines due to no work. Most ridiculous
thing I ever heard of.  Overhire and then I expect MTs are to work 24/7 to get in required lines.  Nothing like making a total fool out of people.  Hardly worth making minimum wage now is it.

I agree they have most likely over hired as this is the first time I have ever run out of work at MDI, holiday notwithstanding and it has now been going on for a couple months now. I am frustrated to the point of tears myself and may be looking for another job. I have tried to address these issues with her to no avail. I do hope things will get better but this will be the last week I can afford to hang on. She said things will pick up this week and I am hoping she is right, if not I too will have to leave. At any rate, I have no complaints personally with Dorothy. She has always been very kind and fair to me. I will truly hate to leave but probably have no choice.
That's exactly what I was going to say. Yes, I work at least 12 hours a day, sometimes 15 hours
to get all of my line count in because I have so many interruptions in my day.  There is no way I would tell my company this nor expect them to pay me OT that they never asked you to do. Unless, I was called by my supervisor and asked to work extra for OT, I would never just take it upon myself to work and expect to be paid.  If you were not authorized to work OT, then your not getting paid. Point blank. I do not work at TT, but I have worked at enough jobs, at home as an MT and otherwise outside of home, that all have the same policy, your paid OT when your asked to work it. It's it is just a case of not being able to get your required line count in 8 hours, then maybe your in the wrong profession or possibly just the wrong company/account for you. This just seems bizarre to me. Just tell yourself, your not getting paid for OT because they aren't approving it so don't work it. Again, if you were asked to work OT, told it would be OT, and then they ask you not to record it, I'd pitch a fit, but from what I see, you've done this on your own.
Why would anyone work 8 hours a week. The poster above said 16 or 24 hours a week.

Instead I sit here hours hoping the Indians leave some work for us so we can at least get our 8 hours in. Nothing like logging onto you shift and being told no work. Nice.

If not, they dont have to hire you as IC or anything for that matter. So yes it is perfectly legal.

If she hires you as an IC and it doesn't state in your contract when she needs that particular IC coverage and she then dictates what hours you work, she cannot do that.


But she can refuse to hire you if you don't provide the coverage that she is looking for.

As an IC, I've never even been able to take a day off to be sick.  I was told that I couldn't take my requested vacation when I wanted it, too.  I tell them the schedule I want to work, but they're always pushing the limits there.  No work for several days, and then too much work that "nobody else can do".  The companies that hire ICs are also pushing the limits on categorizing workers.  They're hiring for ICs to work Tu-Sa, or Su-Th, the pay rate is $.xx, and it's 2nd or 3rd shift.  I'm sorry, but when you hire an independent contractor, they are supposed to set their own schedule and pay.  I'd love to just go down every single job ad and turn these companies into the IRS for misclassifying their employees.  What, do they think we're so ignorant that we'll tolerate it just for the privilege of working at home and carrying their overhead costs for them?  Men wouldn't allow themselves to be treated like this.


You're right, there are companies out there that route work to employees before ICs.  They are not going to pay their employees hourly downtime rates so the ICs can do the work.  IC is low on the totem pole.

I supposedly have 3 backup accounts but never get any work from them either. Usually, I don't mind, but I'm getting a wee bit tired rearranging MY schedule so I can get my lines.

I have an employee job and an IC job. FT is Tues-Sat. IC is Mon-Fri. I told the IC that I won't work Monday, but I will work the rest of the week.

Well, we lost staff to the hurricane in TX and I am the only other one who can do an OP note, so I worked 2 Mondays with that. Then, when the gal came back, she stopped doing the OP notes or even much work for that matter, so I have worked a couple more Mondays. I went for over a month without a day off and then finally, I took 2 days off the PT IC job and a PTO day off the FT job and had a 3-day weekend. I didn't answer the phone or the email and had an automessage back to them: NOT WORKING ON MY VACATION.

I suppose it is what you want to do and if it is worth it to you. I get 10 cpl or better for production on my PT job, so I work them without a lot of grumbling, but I do get sick of it. Sometimes work flow is so low that you gotta and I have been there too.

They do want you to work the hours (sm)
you have committed to.  If you do that, you shouldn't have any problems making your lines - minimum 6600 per week.

between the 3? I have enough trouble working part-time at one and taking care of 3 kids, a dog, my house and husband. How do you do it?
I work 35 hours

The schedules used to be based on 35 hours a week, 172 lines per hour.  I don't know if this has changed with the new account.  It is something you need to discuss with the recruiter/supervisor on your interview.


I type well above 12,000 lines per pay period. So, it is definitely possible.
