Any company who places expectations on its transcriptionists that would meet the threshold of statutory employee status under US and state labor laws is obligated to compensate that Transcriptionist as a statutory employee (benefits, etc.).
The thresholds vary but generally involve the degree of autonomy the transcriptionist has over work flow/location/method, and the degree to which his/her obligations to the company would prevent/allow/require taking additional work elsewhere.
In truth, very few transcriptionists actually meet the legal criteria of independent contractor status. More often, companies illegally claim that their transcriptionists are independent contractors in order to avoid financial responsibility.
If you have any doubts about your employment relationship, please visit the websites of both the US Dept of Labor and the labor department of the state from which you receive work. Please report abuse to the appropriate agencies.
Meanwhile, I can name at least three companies that hire on an ethical, statutory-employee-with-benefits basis: DRC (Digital Records Corp.), Transolutions and Spheris.
