IC or not to IC

At an AAMT conference in 2000 I think, we had a session with a lawyer regarding our profession specifically. Now the IRS being the clear as mud department it is, there are no strict 100% this way sort of laws.
That being said, I would venture to guess 80-90% of the MT companies classifying MTs as ICs are doing so illegally at worst, unethically at best.
One of the key hallmarks would be a single relationship for a business providing the same service. So when I contracted with a major hospital as a contractor, as you point out, they are in the business of multiple things, not just MT. And even though this hospital provided enough work for me to keep 15 MTs busy (as employees for ME), I had the option of offering my services to multiple other clients.
When the MT companies are saying they only hire contractors, it really is up to the MT to be sure they are being classified properly and take steps if they are not. If EVERYONE who is a TRUE IC did this, well, I've been sharing this thought process online for nearly 15 years and it's still the same song.
