I think they can do this...

Once I went to an employment agency for a medical office position (about 10 years ago), filled out all the paperwork, etc.  The agency hadn't yet told me what company they were hiring for and I was still looking for jobs in my local paper.  Well, I had also sent my resume to the company the agency was hiring for and received a call from their HR.  So because of this, I was banned from working for the company for 2 years because I was technically under contract with the agency.  I was soooooo upset!  So like someone else said, these subcontractors are really like employment agencies, not transcription companies.  They have the contract on you as if they FOUND you and so therefore they want the commission for your work.
