I worked for a small MTSO who had a noncompete and the only time they ever flexed it was when one of the MTs went to set up her own business and called on all her favorite clients and undercut their prices to get their work. They never bothered anyone else, even when people left the company to work for, say, the hospital they had been transcribing for the service. They were filling established job postings, so it was completely legal.
