I had the same problem s/m

and the bank will not stamp the check.  You have to deposit it and incur the fee, which for my bank was $10.  Is what the bank told me, was after I deposit it and get it back for NSF, take it to the police station and they will file charges.  The lady that wrote the check was in the same state as me, but different city and I was told going through my local police was fine.  Being that I'm from a small town, the police said that they would call first and let her know they would be filing charges and see if she would offer to Western Union the money or something like that to try and get rid of the charges.

As I was an employee, I was able to call the Labor Dept (I already had a complaint on file) and they did the calling and threatening.  Received my money (cash) approx. 2 days later.
