HIPAA requires damage, not just a loose report...

Posted By: Old MT on 2006-04-28

and HIPAA has basically no teeth anyway. You are talking itty bitty fines like $500. Which is less than $600 a year for liability.Everyone gets their undies in a knot about HIPAA...the only thing ever close to a HIPAA violation was that Indian MT trying to get paid.  So let's get reasonable about HIPAA violations.

Might violate HIPAA ... MTs have to sign a HIPAA (nm)
.
This is just HIPAA on steroids. Cant enforce HIPAA
d
nobody is talking about being cut loose
nm
i agree..cut them loose
Move on. It is obviously all about them and nothing about you.
no schedule or loose sched. sm
Try ProScript, if they're hiring.  PT I think is automatically IC, no bennies, but no hassles either.
Have yet to turn loose of the mouse
On on end, makes no difference about using hot keys or not, most really good, very few errors to change but so long on the mouse, will just stay.
I wonder who did more damage, GP or TT
for filing the suit?   Sounds like that idiot from SoftScript went to TransTech.   I was offered a position by them last year, glad I turned it down.
Or used to work there and knows the damage she can do. nm
nm
It's called damage control
They are reading this board and they know they are going to lose a significant number of MTs. Now how is Dorothy going to look to Transcend. She probably promised we were the most faithful robots ever and would follow whereever she leads. Now Transcend is going to have to hire more MTs to cover the accounts.
I think you are damage control posting all over this board lately.
//
Maybe a spin doctor, or a damage-control
nm
I'm not damage control! I'm really nobody in the grand scheme of things. Just a quiet MT!
That is what is just soooooooooooooo weird still with MQ. I don't know - I've been there for a long time, never talk to anybody, never hear from anybody, my account always has work, and its a great account. I have a back up, which I rarely get a report from. When I do, I admit, its challenging in that I have to look up a doctor here and there, but I just have never had a problem once.  I got transferred to Amherst, too, and everything is fine. No changes. I had some I-mail problems, along with everyone else, called the 1-800 # and got people on the phone immediately, who were super nice. Had a mistake with my check, my fault entered hours in wrong section, and got a person on the phone immediately, who fixed the problem and had a new check out to me the next day.  Its really a mystery to me why some have problems. When I do ask my bosses about it, they say my head would spin if I heard the problems some MTs are - how picky they are - how rude - cherry pickers or will only type on the 3rd Tuesday of the second week after a full moon - never answer THEIR phones, never answer emails, etc. Whole reverse of what I hear on this board 24/7. And I have to admit, I believe the office people who tell me their side, cause I know I've never experienced one singly problem that some MTs on this board whine about constantly.  And I've survived the new QA plan, no big deal at all, and survived the dreaded office transfer - nothing to it at all! So, I can't help but think that we somehow get the treatment we earn at MQ, or at any company for that matter.  And, no, please don't patronize me or kid yourselves. I'm just an MT with some time to kill on the boards tonight!
HIPAA???
How in the world would you think HIPAA applies here? That is for HEALTH information, not employment information!
HIPAA
fast fingers.
HIPAA
All the Homeland Security stuff you are saying is great, but remember it's HIPAA (not HIPPA), the Health Insurance Portability and Accountability Act.
That has nothing to do with HIPAA

HIPAA

The HIPAA agreement will also protect you.  I would never work for a company without one.  It is illegal.  Voice your concerns to your new MTSO and explain to them you will not work until you sign a HIPAA agreement.  I am a service owner and no one works for my company without one!

Its HIPAA.
NM
It is actually HIPPA, and not HIPAA

The contract I signed stated that I could hire assistants at my own expense.  My husband is a great techie and also can lend a listening ear.  I do not agree with your post.  JMO.

The myth of HIPAA

I'm not sure why we put so much faith in HIPAA even at home.  This is a Federal statute that relies on Department of Justice prosecutions.  That would be the office of the US attorney for your area.  Check this out to see just how seriously it is being taken and who is getting prosecuted for what:

The myth of HIPAA

I posted this below, but I'll move it up here since HIPAA seems to be the neverending mantra.

HIPAA compliance, I believe. (eom)

Would this be a HIPAA violation?
Supervisor went away for a week, so her husband (not an employee), sent out the work assignments for our accounts.   I thought computers had to be secure from access by others, including family.
I would think there would HIPAA issues with that.
NM
Question about W9 and HIPAA
I was recently offered an IC position and was supposed to have started already (some on the account have - my computer crashed).  This MTSO is hounding me but never gave me a W9 or HIPAA agreement to sign?  Is this legal?  Any thoughts on this?
HIPAA Stops the the border
x
I stand corrected. It is HIPAA

also s/b HIPAA(hyphen)compliant
x
You signed nothing? Not even a HIPAA agreement? I would think she sm

would be in hot water over that.  Generally, you sign the HIPAA agreement and the contract at the same time.  DId you talk about pay at all and make a verbal contract?

I agree with everyone else.  Until some sort of pay is establishied, I wouldn't work anymore, PLUS, not sure I would want to work there anyway with all of the phone calls and drama that you described.  It sounds like you would be signing up for a duty in Hell.

I'm sorry you have gone through all of this.  Good luck to you.

I'm sorry to ask this because I should know the answer but what does HIPAA say about our medical
going to foreign soil? I'm sure our info is SUPPOSED to be protected, but is there anything that makes this even at least questionable? I'd be livid of my info going to another country regardless of what my profession is!
Transhealth requires 2 yrs nm
nm
There is at least 1 facility that requires US MTs only.
It is actually their largest account. I worked for them a few years ago and worked another service that did this same hospital. This hospital is very picky and absolutely will not allow any offshore work. I guess they will have to keep all US MTs on that particular account in order to keep it.

I would invite all DRC MTs to come on over to TransTech, you will find a home here.
I believe TT requires 5 years
experience
It is SO unbelievable...this job requires
us to constantly keep up with the new procedures, meds, surgical instruments, etc., it is a constant learning curve...and it just kills me that these companies offer less and less money every year...been doing this for 20 years now and it has really gone down-hill! Someone needs to understand what it takes to become a skilled acute care transcriptionist! Maybe the Feds can help us out...they're doling out billions to wealthy investors these days...
Do you really think that this profession requires MORE than others? sm
Come on, nurses, teachers, most other *professions* have to keep CEs updated, etc. Wages are stagnant in *most* fields right now, not just this one.

If you feel like a victim, find something that makes you happier and feel empowered. That's not anything but truth.
Furthermore, I would like to know how the Indians remain HIPAA compliant when there are 27 of them

This is why I say HIPAA is a joke.Edited offshore

Got another, unrelated question...speaking of HIPAA...sm
Working for an MTSO, is it confidential who the clients (the clinics/hospitals) are who you are typing accounts for? Or is that just the MTSO's own rule? I have always kept it quiet but I wondered if this is a HIPAA thing or a company thing.
Agree with poster above, not related to HIPAA, but
most MTSOs do not want you sharing their company specifics, accounts, etc.
First, their HIPAA officer is an idiot and says to use MSN messenger for pt names.

ANYONE with any brain knows that MSN is not a secure environment for patient names, but when confronted and asked, she said yes we could say patient names in that.  A friend of mine who worked there at the same time told them that she would NOT use patient names in messenger.

i wish she had reported that idiot to the bulldogs!

Satellite is not a stable connection. Not in terms of HIPAA or sm
privacy but in terms of stability of speed and signal. Because the signal waxes and wanes, it can cause disruptions in connection. They might not seem evident when you are surfing the net or checking your bank balance, but a VPN connection such as one that is needed to do transcription for many hospitals needs a solid, stable connection. This connection can be fast or slow, as long as it does not go faster and then slower and then faster and then out and then in. A satellite signal does this constantly, by the second, and it causes disruption in the flow.

I betcha it IS HIPAA regs that rule out wireless
Doctors etc. cannot use cell phones to dictate their reports, right? If this is true, I bet the use of wireless to deliver their dictations to at-home transcriptionists is considered potentially not secure. Well, two modems it is for me and I am really glad I asked this question. Thank you all for your feedback.
HIPAA protects the patient; you can mock employees
Unless they were saying something completely fabricated and the employee was identifiable, at which point you might be able to make a case for slander, they can pretty much have a field day at the expense of their employees. As pointed out, though, working for people willing to have a giggle fest over their dismissal of employees leaves a little something to be desired.
you must not have made the grade. He requires
very high quality work, but pay is worth it.
any company that requires YOU to pay THEM is a scam
never ever would you have to pay a STAFFING AGENCY to keep you on a list. The only time you should pay for work is if you are hiring a headhunter to do the search for you.

P.S. I'm not yelling - ... just in case anyone feels that they need to jump down my throat.
that employer requires employees not to say anything on the
.
Nothing wrong with that. Their work requires someone with
that set in stone requirement.
MDI-MD only requires a line count (sm)

commitment and they are now getting some accounts that are internet-based.

Anyone know if Silent Type requires you to fly to NJ? sm

If so, I hate to waste my time (and theirs) by even applying.

Thanks.

Honestly, I am not sure, but since the hospital requires it and I have been through one before..
they just checked to make sure you didnt have a criminal background. The way I understood is that companies in which they require you to handle money i.e. financial companies, banks etc.. require credit check. I had one once when I applied for an insurance company as I would be paying medical claims. So, I really think the hospital will not require this.
Most of my ME work requires little editing.
I still come out ahead on it.

We have our own speech recognition software called DocQspeech.

I like it.

I make 8.75 cpl for my transcription and 7 cpl for my editing. I have greater production on my ME work, though, so that I make a fair amount more when I do edit work than with transcription.
