Found this description of FMLA eligibility

Posted By: mtme on 2009-06-04

Employees eligible for leave under FMLA are those who:

· Have completed at least 12 months of service with the company, and

· Have a minimum of 1,250 hours of service during the 12 month-period immediately preceding the

commencement of the leave, and

· Are employed at a company that employs 50 or more employees within 75 miles.

What if you've already used FMLA leave before, or you think you may use it again in the near future?

You may wonder if you still have FMLA leave available to you. TriNet uses a rolling 12 months

measured backwards from the date an employee uses any FMLA leave. In other words: you’ll look at the

end date of your requested FMLA leave, then look back 12 months to determine if you’re still entitled to

any of your 12-week FMLA leave within that period.

Job Description

I just read this by a poster:  No, MTs are NOT supposed to KNOW if a med is generic or brand. HOW COULD WE?

I sat here scratching my head thinking, is this person SERIOUS?  Do they TRULY believe that they don't need to know simple things like if a drug name is brand v generic?

I read so many people here dissatisfied with the gig they are doing.  Getting fired for no reason.  Ticked off at QA when they only had 6-7 errors.

What is it you think and MT *DOES*?  The job is to translate the spoken word into an accurate and coherent record.

That's what the job REALLY is.  And to take pride in knowing you did just that with the emphasis on ACCURATE.

Yes, the pay sucks for some services. We all have the option to CHOOSE who we work for.  If you can't tolerate the pay, then don't take the job.

Your JOB is to produce a chart-ready, accurate medical document.... and yes, Virginia sometimes that means you have to recognize that when the doc says, pulse 142/90, that the report needs flagged; and it might mean you have to look up new cancer drugs or whether or not something is brand or generic.  If you're doing your JOB, then you learn what's brand or not and don't have to look it up; you know just where to go to grab oncology studies; you know what sites/references are accurate for surgical terms.  You DON'T demand that it's not your JOB to KNOW how to make an accurate medical document.

And if your retort is that services pay crap so you give them crap?  Well then please, PLEASE don't complain when you're also TREATED like crap.

PRIDE - it's gotta start somewhere.

They do not pay for FMLA. That is
just protection put in place by the government to hold your job. The only way you would be paid is if you have vacation/PTO time or sick time available for use. You can be off with FMLA, but not paid if there is no PTO available for you to use.
just by the description of the job, sm
needing someone certain days and certain hours makes this an employee position!!!!! At the very least, it might be able to be called SE (statutory) but I am not sure about that one. I am sure about one thing, an IC position IS IS NOT!
FMLA-MT

Is this part new?  I worked for a national and had FMLA 3 times between 2006-2008 and none of the paperwork said anything about the below.

*Are employed at a company that employs 50 or more employees within 75 miles.*

FMLA
Just one point. No, they do not have to always approve it. There are certain criteria that have to be met including that the person must need full-time care, they are unable to feed themselves, and I forgot the other, but I do know those 2. My daughter had an emergency C-section a few months ago and has an 18-month old at home. She was not allowed to lift either child for 4 weeks after the surgery due to some complications so couldn't pick the baby up from her crib or pick her up 18-month-old to change diapers nor could she herself get in and out of the shower, walk steps (laundry) or basically even get in and out of bed. My FMLA was denied because my daughter could still feed herself. She is an employer lawyer and had told me right away I wouldn't get FMLA, and she was right. It will only be approved if it meets all the criteria.
FMLA
Is true, They must hold your job for 12 weeks, I guess since they do most of their business in India now they think they don't have to follow Federal law.
Meditran Description
Hi there. I understand wanting any and all information you can get, been there lol. Meditran is a small family owned business located in Odessa, Texas.  We were cruising along really good all these years, but then two weeks ago one of our MTs was in a horrible car wreck that killed her husband and critically injured her.  She is doing okay now, but as you can imagine unable to work.  Well this took out two of our MTs as her mother also worked for us. Then we had one MT whose computer totally crashed.  Another MT whose step dad is in the hospital with not much time left. So as you can see we are scrambling. Those of that are working have been completely covered up.  The owner is also an MT and has always hired locally.  This has not worked out very good for one reason or another. So she asked me to place an online ad and see if we could get some help that way. This is strictly and orthopedic account that we need help with.  I have worked for this company for going on four years.  My checks have never been late. The owner is very laid back, she is not a nitpicky person, she just wants the work done and done correctly.  This account does not go by BOS, they have their own standards, which we would teach you. I hope this helps answer any questions anyone may have and if there are more feel free to email me at RoseMT37@aol.com.
She is right on in her description of the company
and their management style.  People who lack experience and qualifications are the ones who are promoted.  There was an MT at OSi who was on 100% review for months and months.  She was then promoted to a QA positon, and while in that position was on the easiest clinical account they had.  BUT, the client demanded that she be removed from doing QA on their account.  And then, guess what?  She was promoted to QA manager.  Many, many, many good QA Specialists and good MTs have left.  Like somebody earlier said, OSi is the perfect place for newbies.  It is not the place for MTs with anything on the ball.  You should honestly check out the whole management staff.  It is very comical.  OSi is a joke.  Sorry to upset your apple cart!
what about FMLA, does that apply? nm

Quit Job-FMLA

Laurie, First I want to offer my since condolences on the loss of your father.

I lost my mother 5 years ago. I don't have much good to say about my former employer, Spheris, but I will have to give them credit regarding their 3-day bereavement policy. My mom was in the hospital about a week before she passed.  At the time I was working M-F, 2nd shift  My brother called me the night she went into the ER, thinking she might pass that night. I emailed my supe and went to the hospital. When she did pass a week later, it was just after midnight between F-S, so I had the weekend off. The funeral was on Monday. I took my 3 days M-W and even asked for an extra day and got it as regular PTO. This was at a time when there were 3-4 hurricaines in Florida, where Spheris was based at that time and they had a lot of employees fleeing for their lives and the work volume was super high. I felt a little bad leaving them in the lurch, but I certainly took the time allotted.

As far as your FMLA, why wasn't it approved?  By federal law they have to approve it. If you have PTO, you have to use that first and then any additional time is, of course, unpaid. Last year, my son was in a near-fatal accident and I applied and was granted full-time FMLA for the first week and then intermittent FMLA thereafter. Of course, I had a ton of PTO accrued so getting paid wasn't an issue for me. At that time, I worked a split a.m. and evening p.m. shift. I tried to work in the a.m. and p.m. and go to the hospital in the afternoon. However, if I needed to go in the a.m., I just emailed my supe. My son lived, thank God, and when he came home from the hospital he had many followup Dr. appts and many of them were in the a.m. due to Dr's office scheduling. I used my FMLA as needed with approval. Occasionally I made up time.

I don't really have much advice regarding what to say on job aps after quitting.

I know this is very long, but I just wanted to tell you that you have my sympathy for your ordeal. Maybe it wasn't the best to quit, but I would still like to know why they didn't approve your FMLA?  Email if you want to talk further.

Sincerely, Lorie

FMLA only gives you the right to be out - the only pay you would get would be saved PTO or short-ter

FMLA - Depending on your state

might pay.  I remember reading NJ just passed FMLA with up to 12 weeks pay (you'd have to be employee status though because it's taken from state disability funds you're paying into) and I think CA also provides for paid FMLA now.  My state doesn't pay for FMLA, but does temporary disability and maternity is covered under that.

Unbearable is a really strong description
for an account.  I've read similar on other forums, so think I may pass.  Difficult, challenging, OK. Unbearable = a bit scary.
Really?! That's news to me... what's my new job description and what are they paying me?
Since you seem to be in the know....
FMLA for the birth of a child
I work for Spheris and am questioning their FMLA policy. They are telling me that while I'm eligible for UP TO 12 weeks of FMLA, they are only approving 6 weeks after the birth of my child. According to what I read and understand about FMLA, for the birth of a child you are entitled to the full 12 weeks but HR is telling me that it's up to them to decide what I am able to take off and right now they feel I only need 6 weeks unless they have a doctor's note to extend it (which my doctor will not provide as there is no medical reason at this time). Everyone else I know gets the full 12 weeks and has never had a problem with their employers so I'm wondering who is right.
which one? give a short description and I'll let you know if Im one of many
.
I'm back. Just read over job description. No PTO is right. Thanks for pointing that out. NM

go to their Portal, put FMLA in Search box, click FAQ.

Disillusioned....Sue's description sounds like the company you just left
except for the rental fee, which they JUST changed recently, and even then it was higher than the one Sue quoted.  I still say you got a much better deal with Amphion.
Control copy, put in in text description, name it then save.

MTSOs have a unique loophole in the FMLA Federal

MTSOs have a unique loophole.  I got caught up in it a couple of years ago when trying to use medical leave for my personal medical illness.

Here are the Federal Requirements:

 EMPLOYEE ELIGIBILITY

To be eligible for FMLA benefits, an employee must:

• work for a covered employer;

• have worked for the employer for a total of 12 months;

• have worked at least 1,250 hours over the previous 12 months; and

• work at a location in the United States or in any territory or possession of the United States where at least 50 employees are employed by the employer within 75 miles.

The loophole for MTSOs is the last one …”50 employees… within 75 miles.”  MTSOs can interpret that to mean “50 employees who WORK FOR SPHERIS” within 75 miles of EACH OTHER.  So, if you live in the middle of Wyoming, there may not be 50 employees within a 75 mile radius of your home.  Thus, the loophole, which some MTSOs actually do use.

HOWEVER, some employees do have a counter-loophole.  States also have FMLA requirements, and the State that you live in supersedes Federal requirements.  In my case my Sate does not have the “75 mile radius” requirement, so after I contacted my MTSO and informed them of that, they backed down and approved all the leave I wanted.

Check out your State requirements to see if they are different.  If they are not, if you can survive with 6 weeks and want to keep your job, I would not rock-the-boat any further.  Personally, I would use those 6 weeks to find another employer who is more employee friendly, if there are any left out there.

Good Luck and Congratulations on the new Baby.

Sounds like the job description for most. As Elmer says, be vewy, vewy qwiet...nm

This is what I have found while looking for the right job - sm
I have one child still at home who will be going off to Kindergarten in a couple of years. I do not want to put my child in day care, so I need a job that provides an adequate window to be able to finish my work. I do 1000 lines per day, 5 days a week. I know that isn't a lot, but with a child at home with me during the day, that's the most I can do at this time. I have yet to find a company who will allow you to have employee status and flexibility with your schedule. Yes, you can generally pick your own schedule with most companies, but I just cannot say that I will be able to finish my work within an 8-hour period of time. That is why I am looking into FN at this time.
To each his own. I have found in all my
years of working at home that what one MT thinks is great, another thinks is not so great. The opinions of the company that I stated are my experience. It could be mine only. I am only trying to help.
Found it! (nm)

I found
a Medical Dictation, Inc. located in Florida.

Has the same email addy. Looks a little...um...well anyway, that's what I found.

I found Beyond Txt to be a
I was not impressed, it took a long time to learn, and the training the pits.
OK, I found it
Thanks I will check that out!
I found some...
I finally found some fairly current posting about OSI. I had to go back to page 20 or so. However, if anyone wants to add anything new, I would love to read about it. Thanks.
What I found -
Most accounts have plenty of horrible ESL docs. There is also lack of work on a very regular basis. Pay is on time and seems to be correct. Communication, when there is any, is often rude, stinging, and nasty for no reason whatsoever other than *someone* is having a bad day. You decide for yourself.
Found it!!
Never mind, unless someone has updated information. I just did a search and found past posts on this company.
That's what I found odd..It was never really an ad..
It really was just someone on the job seeker's board, a Baspen or something saying that some company had contacted her about a traveling job and she was passing on the information. So, no company ever came and did an ad themselves, just supposedly an MT with information. The next thing you know, she is saying the position is filled Now, if she was only just an MT who was asked about a job she didn't want, what is her angle advertising on here for them. I found it odd and thinks this person solicited resumes for whatever reason. I am not sure why it was even allowed on the job board as I do not feel it was very legit.
Thanks! Found it.
I have to buy it. Thought someone could tell me how to delete words/lines at a time, etc.
Let me tell you what I have found about VR
I am on VR and thankful, very thankful a lot of the ESLs on there - the reason is their dictation actually comes out better on VR than hearing yourself. If they have a medication VR is really able to get in a way I never could have imagined. I would not worry about VR being able to get their voices- what I think will probably happen in your job is any and all dictators probably going to VR and then the money for transcribing drops, tremendously. A lot of places trying to do away with straight (the nationals) and get VR.
I have found it
by just typing in MD-IT Transcrip;ton Service.  Their website came up.
Found it, is this it?
The company I have been working for for about a year decided they were not going to pay this pay period because they claimed they did not get paid because of bad transcriptions and they were looking to see who were behind the bad transcriptions and then pay next pay period, which is a month after the work is completed as it is. Also, the work has been under 100% QA, so how could there be bad transcriptions still getting through? Does anyone know if there are legal remedies, as they owe me three paydays if they decide to not pay me.
Think I found it
Do they hire employee or just IC?
I think I found it! Thanks!
I founds some discussion.
We only found out...sm

...in December.  I'm sure the whole thing had been going on for a while, but they didn't tell us MTs until December and gave us about 2-3 weeks' notice.  The conference calls were very helpful and informative, however.  Made the whole process easire.  My TL would always send us emails letting us know what was going on and what to expect...which was not much change from what we were doing already, except for how we report our time/lines.  I just wish we didn't have to fill out all that paperwork again (W-4, I-9, etc.).  The HIPPA and Transcend-specific paperwork I understand, but the others I wish would have just been transferred over. I'm not privy to how that process works, so I just do what I'm instructed to do.

Not sure about the not sending work to India thing.  I believe that Transcend does send work overseas, but it's a small percentage from what they told us.

found it. thank you so much. nm

After 26 yr doing this I have found..
that if a co is paying this way, they are not paying well... the better companies are up front and do it by 65 char line.. no confusin formulas :)
wish I could have found you when sm
I was hiring MTs several years ago!
I would think by now you would have found another job.
Wasting time complaining here.
Here is what I found on ANP ....

I don't know this company and have not seen an ad posted for them, however, when I goggled them I found these 2 sites that are extremely alarming for anyone that would want to apply with them ....

http://www.ripoffreport.com/reports/0/334/RipOff0334462.htm

http://www.ripoffreport.com/reports/0/173/RipOff0173596.htm

While these reports are older, it does send up warning flags, in my opinion.

found a little more...
I would recommend, once again, just using the words of: 'company name' acquisition 'company name'

http://www.google.com/webhp?hl=en#hl=en&q=arco+acquisition+rodeer&btnG=Google+Search&fp=IiS2V33-8Pw

http://www.google.com/webhp?hl=en#hl=en&q=rodeer+acquisition+Lernout+%26+Hauspie&btnG=Google+Search&fp=IiS2V33-8Pw

I think I found it but....
It is for sales not for a transcriptionist.
... I found myself a new job NOT MT, but
I probably wouldn't trust the offer you just threw out there. Cynical MT that I am! It looks like something I'd see on a telephone pole (and used to see, make $30,000 in your spare time doing medical transcription!
No offense, just how it struck me.
The only link I found
http://www.webnow.com/stattransinc
I found a macro to do this for you.
This is the link to the entire discussion and the macro for Word, but since there are several macros to do it, you can go and copy it and decide which one you want.
