I don't know of any companies like this because they have to verify the # of hours you work.  Most places require a set # of hours per week, if you are full time often 32-40 hours, PT 20-32.  All I have dealt with require the hours be met more importantly than the lines, they have to have staff to cover set hours for client needs.  If your lucky enough to type 250 lph, apply for part-time, then you'll only have that 6 hour day you are looking for and not be obligated to type longer, then if you don't meet the line requirement in that time, you'll still have room to type longer without costing the company OT if you need to type another half hour or hour longer than expected to get there.  These companies have to be very careful to keep track of the hours because they are required to pay OT for anything over 40 hours, and they have a minimum line count so they know the have people that can get the work done instead of people that aren't disciplined to type from home.  All of this is just what I have seen in my 12 years as an MT, may be different for other MTs.

Maybe this company is claiming ignorance of US labor laws b/c they are based far, far away. I have no idea, really. It's a lame excuse if that's their thinking. Something's very wrong at this company!
IC labor laws

HAPPY THANSGIVING...  Could somebody point me in the direction I am needing to get the independent contractor labor laws.  And can an employer tell you that you can submit your work in an e-mail if you cannot get into your system.  Doesn't that break confidentialty laws?  Anyway I am needing to know how IC work, works.  Can I set my own hours?  If I am too sick to work for a day and I tell my employer can they charge me a penalty fee?


I would appreciate any help I can get.


Labor laws
That is because a lot of MTSOs abuse the IC status. They treat the MTs like employees instead of ICs. Many years ago I worked for a service that fired someone. That person went to the Labor Board and the service had to pay back employee taxes on everyone. We all had to get a second account to satisfy the State that we were ICs and not just working for one company, which they considered a employee situation.

It is against the law to be fired for turning your company in. If you have a complaint file it. Also, it is the responsibility of the company to keep a log of all hours worked for each employee. The way we are treated needs to come to an end! I cannot take it anymore and am getting out of the MT world after 10 years of working from home. I signed up for some classes at my local college and am actively job hunting. For everything that we have to know to be good at this job we are way underpaid. Ten years ago, I was making more as a newbie than I am now. I may have to start out at the bottom with a new profession, but at least I know I will work my way up...instead of working my way down as an MT. I hope a lot of people read the posts I have put on here and take action. It is scary to go out there after 10 years of being at home, and after all the abuse we have endured our confidence is down, but we are all smart, hard working women and we deserve better.

If children aren't developing a decent work ethic, or expect things handed to them, that's something they're learning at home (or, rather, /not/ learning at home). I'd look first to the parents before I'd start blaming outside influences.
I sent HR the fair labor laws info and asked if it was
for real and had a few interesting phone calls after that.  Later heard somebody didn't make lines, got fired, appealed and proved we had no work, and UE told Precyse they have to pay.  So pick a story..... It's like anything else, believe what you want. 
LABOR BOARD / MINIMUM WAGE LAWS

Regardless of all the bull dished out by the MTSO companies, especially as it pertains to VR, i.e., We're cutting your pay 50%, so you'll have to work twice as hard - but you're going to LOVE the platform.  Also get tired of hearing about Learning Curve and wonder if my grocer, landlord & hungry kids understand this learning curve concept. 


However (and the MTSOs can like this or lump it) WE MUST BE PAID FEDERALLY-MANDATED MINIMUM WAGE for workers with employee status - whether straight typing, VR or being required to babysit computer during no/low work.  Of course, it's exploitation to cut wages in half from an already insultingly low rate & most MTs are surely feeling the pinch.  But whether 2, 3, 4 or 10 cpl ... minimum wage must be paid.  (Sorry Suits/MTSOs - the law is there for a reason!)

In my state, the number one reason to qualify for unemployment is lack of work, even if you are still employed (a lot of circumstances to consider here).  The company can threaten you all they want about production but if they are not providing the work, that is their fault.  If they let you go, you DO qualify IN ANY STATE if it is for lack of work.  The unemployment here has a 1 week waiting period, but apply for it ASAP.  It is only going to be about 50% of your regular income though.  This is determined by the highest amount of quarterly pay you received in the last 5 quarters. If there is any unemployment office near you, they can answer your questions.  You can even apply online there with a counselor available to help you if you have any problems.

and you don't have to be asked. If you work it, asked or not, they have to pay time and a half OT rate for hours worked over 40 in a week.

Taken right from U.S. Dept of Labor -
An employer who requires or PERMITS an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA)MUST receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

If state insurance laws mandate it
they will, or they will not be allowed to sell policies in that state.  I believe Illinois requires coverage for IVF.
Every state's Dept. of Labor has...sm

rules and regulations re. unfair labor practices.  I don't just mean the BS with the IC and set schedule baloney.  What about:


1.  Requiring an employee to work a set schedule of hours, but not being paid for your time, just the actual lines produced during those hours.


2.  Being told during your set, scheduled shift/hours (which you're not being paid for, remember?) that, sorry, no work or work is slow, but you can't take the day off, because, what if everybody decided to take the day off.  Ergo, must sit glued to seat until work comes in.  Needless to say, line quota not able to be met in the specific schedule you're bound to but not paid for.


3.  Told at end of week you must make up line quota or, (take your choice):


a) Lose bennies for that month.


b) Expect a phone call (who is paying whose phone bill?  I know who's paying mine, and that's why the Almight invented voicemail).


c) You lose job w/o cause... it's in agreement, after all. Hire Indians or other US MTs who are desperate and who'll work for $0.01 less than you are.


d)  We take your first-born (That's next.. with what they are allowed to get by with).

I believe it can also be handled by e mail.  However, by the time they get around to helping you, the lines you speak of should be on your NEXT paycheck and they will say there is no harm done.  The company may have a valid point if the lines are not counted until they clear QA (???) but I would definitely make sure they are on the next paycheck.
Go to your State Labor Board & for a few bucks, file a complaint.

The MTs joined the same union as the nurses' in a hospital in Washington State sm
I can't name the hospital for confidentiality reasons; however, they truly is their payscale and benefits.

Also, there are unions in California Hospitals also. Those MTs also joined the same union as the nurses. Go figure.

Also, these MTs are at home employees. No kidding!!

Honestly, do your homework and you will see that this is the truth. Some hospitals are willing to pay and have union workers.

I hope you do well.  I would rather have a root canal than drive a bus around with the rowdy kids around here, my gosh, they get in fights all the time, the bus driver has to return the bus to school.  You are probably from a better area, but they would have to pay me big, big money.  Good luck to you though.

Have had good luck with them since Feb.
I was told about a horror story that went on between them and one MT when I was brought on. Nothing even close has happend to me or another MT that I talk to from Medscript. Perhaps it was a two way horror story for the owner and the MT? I will post an email address if anyone has specific questions I can try to help.

I worked for MQ for years, and if you want ANYTHING you have to continuously harass "the higher ups." Remember, it is your money, and it is owed to you, don't let up on them or you will get NOTHING! Management sucks at MQ.

Bascially DSG wasn't willing to pay me what they thought I was worth, which sounds stupid, but it's true. Everything else except for the pay was perfect. I loved working there, and I recommend them. They have had some growing pains in the past, but things have leveled out quite a bit. I wish you the best.

I was offered the same deal but there was no work when I started.  Nada, nothing. I had 9 jobs for an entire week and was told I couldn't get a backup because I wasn't off of 100% QA, and couldn't come off 100% QA because there was no work!!!  When I left, they did NOT pay the training bonus as promised and I reported them to the Attorney General.
Don't know anything about them but good luck!!

Bet it is the same company I worked for. If it is, you will never get it. Was told my check was in the mail 10 months ago, and never received it. I had my own equipment so there was nothing to return.

I did not have good luck!
Jim, the hiring manager, was supposed to send me all of the new hire papers, etc. No word from him. I e-mailed him constantly and called him constantly to find out where the papers were and when I was going to start. He totally ignored me. I call that very unprofessional. That should tell you something about the company. There seems to be a big turnover because they are always constantly hiring.

I went into that totally blind and naive.....never again...lets face it...if your willing to put forth all your effort looking up things that the company should have referenced you with before they threw you into a contract....that tends to leave a bitter taste in your mouth!
