My attorney told me that noncompete clauses
are illegal and not enforceable because one person cannot stop another person from making a living EVEN if you sign that noncompete agreement. I went through it with both a pharmaceutical company and a transcription company trying to prevent me from working for their clients or competitors. I can see their point as an independent contractor when it comes to offering the same services and essentially stealing their clients. However, as a former employee, nobody can tell me who I will or won't work for. The second attorney is correct, and I would follow his advice.

and make a monopoly, set the prices, standards etc. Been there. Not that long ago Transcend bought up anotherd company, 137 or 140 employees, now they have no work. She posted on MTDaily. Really sad for sure.
Thanks guys for taking the time to respond to my post. I'll go with the State job if offered.
I may do some PT/IC a couple days of the week just to keep my skills up and just in case they offer the lower rate of pay.

In my state, if they hire you full time, then do not provide the work you can draw unemployment -
You would have to talk to someone in your state, but I was able to draw partial unemployment while still working in Georgia. I had to report in each week how much I made and they gave me partial benefits. To qualify, you had to have been hired full time.

Competition is the Name of the Game!

What we have always seen happen within the U.S. between U.S. workers in the job market , competition , is expanding to the global marketplace. U.S. workers now not only have to compete with each other in the arena of  marketable skills , they must also compete with those in other countries who not only possess the same marketable skills , but do so at lower prices. Naturally , a company which can get the same production out of a worker for a smaller price is going to choose that worker, as the savings in labor costs will increase the bottom line.We lost our manufacturing base on just this scenario...a fatal blow to the soundness of our economy , IMO. That left us with a service sector base , which is also facing the same threat , with the likelihood of the same result , suffered by our manufacturing base.


One solution is as Obama has suggested. The feds take away any tax breaks companies which outsource get to the deteriment of U.S. workers. Will the U.S. government do something like that? I doubt it. Look at what is happening right now over the issue of illegal immigration into the U.S. We were attacked on 9/11 ; drugs and criminal are being brought across our borders ; our law enforcement officials and citizens are under attack ON OUR OWN SOIL from those coming across the border ; and in the economic arena , companies are hiring illegals and undercutting U.S. workers' wages.


The People have demanded the border be secured and the Congress passed a bill calling for U.S. border security. But , what has actually been done? NOTHING!!! Why? Because the feds don't want to secure the borders. If they did , the borders would be secured , or at least a serious attempt would have been made. So , why haven't they secured the border? Because U.S. companies want to employ illegals and pay them lower wages , thus increasing company profits. The dirty little secret , that isn't really a secret , is that our legislators and president are all about serving their masters...and that isn't We the People ; that is the corporate and banking classes who fund their campaigns and give them lucrative positions in their compamies when they leave office.


So , unfortunately there it is.

Editors clean up American MTs and Indian MTs. Bottom line is COST!!! DUH! It is just like everything else being made overseas in China, Mexico...IT IS CHEAPER THERE!

Does anybody know of any hospitals or transcription companies who are hiring for part-time ER work on eScription?  I have been doing eS for 5 years and have my Advanced certification in EditScript and am looking for an additional account.  It needs to be a flexible position because I have another commitment.  If anyone has any leads with decent pay, please feel free to send me a confidential email. A company would not go through the expense and time of hiring you only to not
contact you. This smells fishy. It is not the first time you have said this but it does not sound right.

I need flexibility.  Willing to do a certain number of lines every pay period.  I started with MedScribe of NJ and already they run out of work and seem to be dodging my emails about a secondary account.  Afraid I made a bad choice.....

Yes, they are now hiring part-time MT's but only where absolutely needed. sm
They tried going to FT only but decided that was eliminating some good/great MT's.

I was told that the reason they were trying to only have FT MT's was that if someone worked FT for a different company and PT for them, they were burned often when the other company needed OT or schedule changes and that the KS lead MT's were left without coverage.

I started FT and went PT for family reasons and do not work for another company. I hope to go FT again in the future, but they worked with me to find a schedule that worked with my situation.

Who is hiring part-time for ER, ortho, clinic dictation? sm
I have over 14 years experience. I love doing orthopedics, ER notes, and clinic dictation.  Does anyone know of a company who is currently hiring for PT work right now?  I am looking for a company that you don't have to spend weeks and weeks filling out paperwork, calling back and forth, waiting, waiting and waiting to begin work.  I am very dependable, hard-working.  Looking for someone that can respect that in this day and time.  Any information would be greatly appreciated. 
Unless something has changed, health insurance rates vary state by state, so we may not have the
info you need.  I'm an IC so I don't have benefits.

Be careful right now, because TT has much overhired, promising something big coming up, but nothing seen by the MT's yet, just LOW WORK load.
You are correct. The state that rules is the state the employee lives in.
My state laws has is spelled out in their Code. If another state does not withhold, they are fined heavily and if they don't withhold for years, their fines are pretty bad. I worked for a Florida co that did not withhold income tax for my state even after I brought it to their attention in the state code. They kept saying that they would eventually and never did. After two plus years and when I left, I made it known to my state all the conversations, the state refunded me all late fees they charged me and then said they were going after the company in Florida because they had many employees in our state. They deserved it. They knew better.

If company is in state that has no state taxes
they are not required to take out state taxes.  It's enough to keep up with your own state tax law code, could you imagine having to stay abreast of 49 other state tax codes?  The cost would be huge and ultimately passed on to us by lower line rates.  Regardless of who owes the tax, someone has to pay it.  Just a matter of convenience I guess.

and you don't have to be asked. If you work it, asked or not, they have to pay time and a half OT rate for hours worked over 40 in a week.

Taken right from U.S. Dept of Labor -
An employer who requires or PERMITS an employee to work overtime is generally required to pay the employee premium pay for such overtime work. Employees covered by the Fair Labor Standards Act (FLSA)MUST receive overtime pay for hours worked in excess of 40 in a workweek of at least one and one-half times their regular rates of pay. The FLSA does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest.

Extra pay for working weekends or nights is a matter of agreement between the employer and the employee (or the employee's representative). The FLSA does not require extra pay for weekend or night work or double time pay.

Different state to state. You would be surprised to find

IC can be defined differently state to state.  Even the IRS cannot come up with a definitive set of rules.  You would be surprised how many ICs actually get unemployment in some states.  If the unemployment claim form asks specifically if you are an independent contractor, do not lie, but if it does not, do not volunteer it.  Let the company prove you are a true IC according to the rules of your state.  All you lose is a few minutes filling out the claim form.  I would only do it as a last resort.  If you can find work fast, by all means go for it, but the way things are now with all the VR and off-shoring, it is a backup if you cannot find work.  No one should go hungry because they are afraid to file for Unemployment as an IC.

You said you typed 130 wpm yet you only make $17 an hour on VR. No way would you make that little with typing straight at 130 wpm. You must be thinking 130 lines per hour! 17 bucks an hour STINKS! I make $20 an hour typing and I made $25 an hour editing humans. !!!! so there smarmy pants!

 First of all, you're obviously mgmt. since you know so much about inside goings-on.


Second, and here is where the fib comes in:  You expect us to believe that Leads don't  type on their own lead shift  (they're too busy, too much to do-LMAO) - and their lead shift is obviously a 40-hour shift, if the hours on the bottom all of their holier-than-thou e-mails are to be believed - when DO they do their transcription - during their SECOND shift or 41st hour ( I assume they finish their 40-hour lead shift and then get paid OT to do their typing).  Are you another one who thinks all the rest of us peon MTs are so dumb.  MTs regularly get the halfway decent work taken out of their queus and get h--l when they compain about it.

I wondered if perhaps the OP was attempting to alleviate her own guilt about staying for some reason.

As one of the MTs who DID leave as soon as they saw fit to quit routing their MTs work, I just kind of chuckled at her wondering which MTs actually left. I don't know about the OP, but there's no way I'm spending my valuable time sitting at a computer waiting for a few reports to trickle in. There are too many other 'fish in the sea'. We were not even employees; we were SE or IC status. They owed me nothing but a paycheck and I owed them nothing but my daily line commitment.

I'm not going to be loyal to ANY company that would, by choice, let MTs sit and starve while they ignore emails and deceive their staff. My loyalty is to myself and my family, for whom I provide. Other than that, I've never had a problem separating my 'professional' life from my 'personal' life.

I feel no guilt whatsoever. It was not my role in life to 'serve' MDI (or any other company). They contracted my services and my loyalty to them was in force during whatever hours I would transcribe for them; other than that, call me insensitive or selfish or greedy, but I don't feel guilty about anything regarding my actions.

They chose to sell, I chose to walk.

Plain and simple.

from the clients when the trouble was going on in India and most of their clients demanded to be brought back onshore.  That is why most of the accounts are so good....very good dictators.  remember, the easy stuff always goes offshore.

I got caught in a new job awhile back
that went dry for months and it really hurt me financially. Loved the job, loved the people but was on the brink of bankruptcy. My advice would be to keep the sure thing in these economic times. Good luck to you whatever you do.
It caught me by surprise too -- I'm right there with you. Fortunately, I have a 2nd job sm

so that helps take the sting out a bit.  I love the people and love the company, but I do not think maybe they realize what a big shock $30 can be sometimes.  To me, the more fair thing to have done would have been to say something like effective next check, we will be taking out double premiums until we catch up or whatever.  However, cannot unring a bell.


And I have always been a bit disappointed that they wait until the following Monday to pay us instead of that Friday, but for the most part it is a good company.  Seems like all of the MTSOs hang on to their $$$ as long as they can -- guess the interest is better in their pockets than on our paychecks.    I was stupid and am now waiting a month to get paid for work I did for a woman in Virginia.  Chalk it up to lesson learned.

I think you are precisely right in your perception that communication is discouraged, as I have heard this (but have no proof of it) in the past, not just about Transcend but a few other MTSOs too, that they prefer to keep their employees 'remote' in all senses of the word, including not communicatng with one another.

I don't think you're being kept out of the loop; I think the only 'loop' might be a chosen few higher-ups that communicate.

I could be wrong, but I felt the sting of your post and wanted to let you know it's probably not personal at all, but something shared with a privileged few.

I caught that too - "self limiting" gawd
It is the lack of being paid a decent wage for the skill provided/expected, What would it be 40, 50, 60% paycut for the same skills and expectations from the MTs.

Management is paid big wages to manipulate the numbers, and convince the MTs - things are fine, DONT self-limit, you are being treated just fine, the wage is fine, we are fine, you will be fine and the suits march off to the bank.

My heavens have a conscious, don't treat the MTs like a backroom sweat shop, slave labor, like sewing machine workers paid by the piece (literally pennies a piece) and the product is designer labels bringing in thousands per product. Both sides have to be able to survive and not work like slave and still not be able to make it money wise, pay bills, etc
