I've just about reached that boiling point I talk about
'treading water' until our government does its little changeover in January. Then, whoever ends up in office, as well as those who work beneath them, are going to start hearing some MAJOR complaints about the MT industry. I have a friend who is always talking about 'the Power of the Pen'... meaning that the written word can be a powerful weapon if it's used correctly. And for MTs, who are in the BUSINESS of words, I think we have a vast, untapped power to get some changes made in the MT industry. If the MTSO's are going to reap greater financial gains by sending a major part of our work offshore and exploiting overseas workers, and then turning around and exploiting US by trying to make us work for 3rd-world pay, then by golly, let them pay for that privilege.
I think the MT motto for the year 2009 should be 'NO MORE BUSINESS-AS-USUAL'.
Things can't get much worse in this industry, so I believe there was never a better time for a major overhaul of it than 2009 and beyond. Time to 'out' the MT industry, make it a household word, and clean its dirty laundry.

I did complain and received a tertiary account. It did get a bit slow for a few weeks around the holidays, but everything seems full speed ahead now and I have more work that I can get done. I never considered quitting. MDI has been very good to me. Sorry your experience was not the same. :(

I always send my invoice in the minute it comes to me, so I hope something is not messed up. However, I did send an email to the powers that be rather than just sit here and kvetch. I know I will be paid, but today would have been a welcome surprise.

You’re half correct. What you would become is a statutory employee (SE), not a “regular employee,” like you would be if you worked in an office. In the case of the SE, the company and/or individual they provide service for would be required to pay 7.5% of the social security tax, but that’s as far as it goes. You would still need to withhold your own federal tax in addition to other taxes like Medicare. Furthermore, and the law used to state that anyone who works exclusively for a single company/individual is classified as a SE, by law.
The 20 guidelines I posted here and on the Main Broad are merely a framework. Each individual should speak with a lawyer who specializes in Employer/Employee law or directly with the IRS.

I don’t agree that (all) MTs are convinced it’s okay. They’re simply not fully aware of the laws, or they know the laws but feel they’re stuck “between a rock and a hard place.” Either they “agree to the terms” (of the contract) or they won’t be able to pay their bills. But, it’s still the element of control and the MT *still* has the final say: “I agree to the Tues-Sat shift for 8 cpl.”
There are two other issues that come to mind. First, the line rate. An IC determines what constitutes a line, and informs the client accordingly. Usually, they choose the software they wish to use (i.e. Sylcount), but sometimes the MTSO will tell them, “We use Abacus and count spaces and returns only; no formatting codes” and that’s okay. However, if you have IC status you should NEVER let the MTSO do the line calculation on their end and then tell you how many lines you’ve transcribed. Doing so gives the MTSO “the element of control,” which makes you their employee.
The second issue is a little trickier and it concerns the “application process.” Again, what applies to the IC also applies to the MTSO. When the MTSO approaches a client (i.e. Osh Begosh Hospital) to offer their service, they try their best to sell their service and secure a contract in the process. They do not fill out a job application nor do they take a transcription test. That’s what an employee does, not an IC. The IC provides references, and that’s it.
In the final analysis, knowing the law is one thing and adhering to the law is another. You can tell the service what the law is, and they can just as easily tell you that your services are not needed. And, unfortunately, that’s pretty much where it’s at right now and where it will continue to remain.

Have reached the magical age
Past retirement now although still working because I like to make money. Anyway, this is a good age because if things go keplunk, oh well, have my social security and retirement check to fall back on. But really, the hospital where I have worked for the past 19 years has had electronic records for, I think about 6 years and the MTers are still around.

Life IS short, and some of us have reached -
a point later in that short life where the job we once loved is now screwing us, and there is no longer the time, the energy, nor the money to go back to school to learn how do do something else. We made the mistake of putting all our eggs in the MT basket decades ago, when the MT profession was completely different. It changed for the worse, we stuck it out, believing things would turn around, and they didn't. If bitchin' about it makes me feel a little better, so I can get up each morning and keep plugging away at the only thing I know how to do, I certainly don't need any judgement from someone who is probably in the same position, but too full of themselves to admit it.

And I believe that the worm is beginning to turn. Perhaps your husband's company should be confronted en masse regarding layoffs.
Don't go softly into that good night. Ask questions, do your research. We stil have rights, but a good deal of you are scared into corners, frightened to proclaim those rights.

Thank you! Most people in the business are busy and most have a number where they can be reached.
They put it out there for a reason. Sometimes it is impossible to get back with people that you have every intention to get back with and that's why you tell them that if for some reason you cannot get back to them, to call you back. I know I have been told that and I have followed through and usually they were very glad that I called them back. It has happened with a few companies. It is not that they do not care. It is that they are very busy with the current applicants because it is not that they just get just one application a day from MTs. Many companies get many applications a day and I don't know many companies that have multiple recruiters.
Workload has reached a manageable level with everyone working scheduled hours.
Voluntary OT is still available on some accounts.
Me too. As soon as there is a little extra work they hire and hire and then noone has any. This
goes on all the time. I get sick to death of it. I think having 2 part time jobs is better so you have 2 jobs to count on.
I am so glad, so very glad that finally I have reached
the age that if we are low on work, I just take off. No problem at all and love the extra day or so off. I now have worked since the 70s and finally made to retirement age, get SS plus other retirement money coming in and thank the good Lord do not have to worry about if there is work or not. BTW, when I worked inhouse never ran out of work ever, only when transferring out to company do they run out of work. If I had to raise a family now I would most certainly cross train on other accts at my place but only have 1 that I work on, by choice.

I thought I seen a post somewhere on here that said only FT. I really don't want to work more than 30 hours a week and I know most places cut FT at 32 hours a week. Not that I couldn't put in 2 more hours, but if I had a choice....

I just took a position with MD-IT Portland. I am very optimistic about this! It was a much higher line rate than I had with MedQuist, and for now they pay the same for straight transcription as they do for Speech Recognition. They are providing all of my equipment - as I am going to one of their accounts where they do, and it is mostly my favorite work type, ERs.
If you do not do ops they will not hire you.
I hate ops and have never had a problem getting hired and paid decent but this company will not even look at you if you do not all 4 acute care. I wish I liked ops but do not. I applied for this company and this was the first time in my 9 years experience that I have had a company turn me down so their loss as far as I am concerned....

someone to paint the exterior of my house - as an independent contractor - and allow her to do it any hours she pleases as long as she does a previously arranged percentage of my house within a 24-hour time period. I think this is closer to the way being an IC works. At least, this is how it is for me. I have to complete x number of lines within 24 hours, but whether I do it in the first hour or the last hour or anything in between is up to me.

I have 2 years experience and passed their test the first time and was recently hired. I have heard bad and good. I intend to do my job and as long as I am compensated for my work, it is a job.
REMEMBER THE COUNTRY'S UNEMPLOYMENT RATE IS IN THE DOUBLE-DIGITS PRESENTLY AND BE THANKFUL YOU CAN FIND A JOB.
